Goldberg Allen Lane and Lothrop Inc. and Lease Back Partners LLC“GALL/LBP” presently has a pending US patent on the Sale-Lease Back/Plus™ structure. When a US patent issues, GALL/LBP will have the right to prevent others from making, using, selling or offering for sale the patented invention within the United States during the term of the patent. The patent laws also provide GALL/LBP a remedy against third parties that to contribute to, or induce others to infringe. Unlike copyright, patent infringement doesn't require that the infringer copy, or even know of the patent -- simply carrying out the patented invention creates the cause of action. GALL/LBP is entitled to damages and in most cases an injunction against further infringement. Damages awards can be in the form GALL/LOBP's lost profits or other measure, but "not less than a reasonable royalty." Where infringement is done with knowledge of the patent it can be held willful, and damages can be raised up to three times. The statute also provides for attorney's fees in exception cases; attorney's fees often flow from a finding of willful infringement.
